Privacy Policy

THIS PRIVACY POLICY WAS IMPLEMENTED ON OCTOBER 9, 2009 AND WAS LAST UPDATED ON OCTOBER 9, 2009.

We have adopted this privacy policy (the “Privacy Policy” or “Policy”) to protect your privacy and personal information and to let you know how we might use it. This Privacy Policy applies to activities you perform on our website (the “Site”) and activities or communications that occur using our services or the Site (the foregoing actions are collectively known as the “Service”) and does not apply to any other website. This Policy may be modified from time to time by us in our sole discretion. Please periodically review this Policy to be updated on modifications hereto. Each time you use the Service or the Site or provide us with information in connection with the Service, you are accepting the terms and conditions in this Privacy Policy at that time. As used in this Policy, “we,” “us,” and “our” all refer to First Beat Media, Inc. or any of our successors or assigns; and “you,” “your,” and the “user” all refer to you, the user of the Service and the Site.

Information We Collect From You

In order to operate the Service and the Site and to provide you with information about employment opportunities or services that may be of interest to you, we may collect from you, or you may be asked to provide, personal information, such as your name, address, credit card information, or email address; or demographic information, such as your gender, age, race, zip code, profession, or interests. Demographic information is not specific to you, but rather identifies broad demographic groups of which you may be a member. Personal information can be used to contact you personally, but demographic information cannot be used in this manner.

We may also collect behavioral information, including the way you use the Site, your IP address, you computer and browser type, the operating system you use, your access times to the Site, and referring websites that directed you to the Site. We use this information to resolve problems with the Site and to improve the Service for you and other users.

It is important to note that you do not need to provide any of personal information to perform job searches on the Site. However, you will need to provide the requested personal information to use other aspects of the Service and the Site.

California Residents

If you are a California resident, you have the right to receive: a) information identifying any third party company(ies) to whom we may have disclosed, within the past calendar year, personal information pertaining to you and your family for the company's direct marketing purposes; and b) a description of the categories of personal information disclosed. To obtain such information you must make a request in writing. For your request to be processed, it must include your name and email address, the URL for the website you visited, and a return address. We will honor such requests only once per calendar year. How We Use Personal Information

We use your personal information to help us efficiently operate the Service and the Site, to create a personal account and profile for your use, and to contact you in connection with your activities on the Site (including, but not limited to, confirmation emails or important news that could affect your relationship with us). We may disclose your personal information to third parties if you consent to such disclosure. For example, if you make your resume searchable in our online resume database, then all parties with access to our searchable resume database will have access to your resume and personal information. If you indicate by configuring your profile that you would like to receive information about the opportunities, products or services of third parties, we will provide your contact information to employers, recruiters, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third party.

We also use personal information to send you newsletters, offers and other promotional materials for our or third parties' goods or services. We endeavor to send you offers that are of value to you, such as discounts, exclusive offers or special event information. The Site provides you with options to decline to receive communications (other than those contained in Relationship Communications). Some of these options may only be for a certain category of communications; others may be more general.

To operate the Site, including processing your transactions and supporting your activities on the Site, we may share your personal information with our agents, representatives, contractors and service providers so they can provide us with support services such as authorization of credit card transactions. We require these entities not to use your information for any other purpose.

Any third party with whom we are allowed to share your personal information is authorized to use your personal information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control, and you agree that we are not responsible or liable for any of their actions or omissions. Those who contact you will need to be instructed directly by you regarding your preferences for the use of your personal information by them.

We reserve the right to disclose your information when we are required to do so by law or to cooperate with law enforcement or court proceedings. We may also share or disclose your information in connection with a transfer of ownership, in whatever form, of the Site.

How We Use Demographic Information

We may use demographic information to tailor the Service and our communications to you to your specific interests. We may also share demographic information with advertisers on an anonymous and aggregated basis. One of the reasons we may do this is to increase the likelihood that our advertisers' goods and services will appeal to you.

Our sharing of demographic information with advertisers is anonymous, subject to the rest of this Privacy Policy. When you respond to an advertisement, however, we ask you to remember that if that ad that is targeted to a demographic group and you decide to give the advertiser your personal information, then the advertiser may be able to identify you as being a member of that demographic group.

Your Resume

When you post your resume on the Site, it is stored in our database in the United States. You decide whether you would like your resume to be private or public.

When set as “private,” your resume is not searchable by potential employers or other with access to our resume database.  You may still use your resume to apply online to a job. If you do apply online to a job, your resume will be transferred to the relevant employer, who may retain a copy of your resume or distribute it to third parties, subject to local law. You understand that we cannot control their use and retention of your resume information.

When set as “public,” your resume will be searchable by potential employers (though you can still choose to have your personal information kept private, even from these employers). Even without your personal information, employers may be able to identify you based on circumstantial evidence in your resume.

When set as “public” and you choose not to keep your personal information private, employers and any other party with access to our resume database will be able to contact you.

While it is our goal to limit access to access to our resume database to legitimate users such as paying potential employers, we cannot guarantee that unauthorized parties will not gain access to our database. Nor can we control the way authorized or unauthorized parties that access the database may use of any information they may acquire through such access. As such, we suggest that you not put sensitive information in your resume that you would not want made public.

Employers or other parties with access to our searchable resume database may be located in countries whose data protection legislation may not be equivalent to the laws in this country. 

How You Can Access and Update Your Information

We give you the opportunity to opt-out of certain communications and to modify personal information or demographic information you have provided to us at anytime by going to the "Account Settings" in your account on the Site. Please be aware that it may take several hours for the changes you make to take effect. We thank you for your patience. Please note that changing or deleting your information in the "Account Settings" section of the Service, or otherwise opting-out of receipt of email communications from us, will only change or delete the data in our database for purposes of future activities on the Service and for managing future communications from us. These changes and deletions will not change or delete emails or information that we may have already forwarded to other users or credit card companies or any other third parties, all as provided above in this Privacy Policy.

If you wish to delete your account information or close your profile altogether, please contact us. An email will be sent to you to confirm that your personal information has been deleted, except for an archival copy. The archival copy is retained only for as long as we reasonably consider it necessary for audit and record purposes. We will retain logs, demographic, indirect, and statistical information about you and keep an archival copy of this information in an anonymous form. If your personal information was previously accessed by others using our Sites, we are not able to delete the information or copies thereof from their systems.

Like most other websites, we use cookies to protect and enhance your experience on the Site and using the Service. We cannot guarantee that unauthorized third parties may try to or indeed access the Site and obtain your information, and you understand and agree to this potential risk.

You agree that you are responsible for helping to ensure the integrity of your information by, among other actions, keeping your username and password confidential, and not providing your social security number or financial information to anyone on the Site.

With regard to any financial transactions you perform on the Site, we use various encryption technology to ensure that your credit card information is used only for its intended purpose.

Persons under 13 Years Old

We do not knowingly permit persons under 13 years old to register for or use the Service, nor do we knowingly collect or solicit personally identifiable information from or about persons under 13. Further, we do not store any personal information of users who indicate that they are under the age of 13.

In the event that we learn that we have collected personal information from a child under the age of 13 in violation of this Policy, we will immediately delete such information. Changes to the Policy

We may change this Privacy Policy at any time. You agree that we are under no duty to send you notice of any such change. Instead it is your responsibility to check this Privacy Policy from time to time. No change in the Privacy Policy will be effective until thirty (30) days after it is posted, unless such change to the Privacy Policy has clear language indicating otherwise.
